Types of Robbery: Penalties for Robbery in California
Robbery is defined as the theft of property or money by using force or the threat of force. Robbery may be classified into different categories, where different punishments are enforced in California.
- First Degree Robbery: Robbery of a residence, inhabited dwelling, ATM, or person in a vehicle. This is punishable by 3 to 9 years in state prison.
- Second Degree Robbery: All other types of robbery (such as a mugging – robbing a person on a public street). 2 to 5 years in state prison.
- Armed Robbery: Robbery with a weapon (such as a gun or knife).
- Robbery with a Firearm: Robbery using a gun. This offense adds 10 years to your prison sentence.
- Discharge of a Firearm: Robbery wherein a gun was fired. This offense adds 20 years to your prison sentence.
