MAN GETS 15 YEARS FOR RAPE
Posted By The Law office of Barney B. Gibbs

A man found guilty of stalking and raping an Orange County woman he met via an online dating service was recently sentenced to 15 years and eight months in prison.

The 54-year-old Oregon man, who initially began communicating with the woman online in 2003, came to Orange County in 2007 to meet her for the first time.  According to prosecutors, after dinner, the man lured the woman inside a hotel by promising her flowers and then sexually assaulted her.

The victim did not report the rape for the next year and a half during which time the man stalked her through phone calls, emails and unexpected visits to her residence.  It was after the man was arrested and charged with stalking that the victim reported the rape.

At sentencing, the man continued to deny the charges claiming he was suffering from a delusional disorder.

ORANGE COUNTY MAN CHARGED WITH SECOND RAPE
Posted By The Law office of Barney B. Gibbs

A 40-year-old Costa Mesa man accused last year of raping a 17-year-old female employee has been charged in a second rape.

In July 2009, the man, a former manager of a dry cleaning company, lured an underage female employee to his home under the guise of picking up work-related paperwork. Once there, he locked the girl inside and raped her.  He then threatened to report her illegal immigration status to authorities if she went to police.

The latest charge stems from an October 2009 incident in which the man is alleged to have broken through the door of a female acquaintance and raped her.

The additional rape charge raises the man’s prison exposure from 8 years, 8 months to 60 years to life.

FORMER CHP OFFICER ON TRIAL FOR ALLEGED SEX CRIME WITH A MINOR
Posted By The Law office of Barney B. Gibbs

Trial is underway at the Santa Ana Courthouse in the case of a former CHP lieutenant accused of attempted lewd act with a child under 14.

According to prosecutors, in 2006, the defendant sent sexually explicit Internet chat room messages to an undercover officer, whom he believed was a 13-year-old girl, and then drove 45 minutes to meet the girl at a park in Laguna Beach.  He was arrested as a part of a sting operation orchestrated by PervertedJustice.com.

The defense attorney claims a not guilty verdict should be rendered because the defendant did not have the intent to engage in a sexual act with a child.  Prosecutors, however, argued intent was present in the fact the defendant arrived at the park with numerous condoms.

If convicted, the defendant may receive up to four years in prison and be required to register as a sex offender for life.

YORBA LINDA MAN CHARGED WITH RAPING 2 WOMEN FROM MYSPACE
Posted By The Law office of Barney B. Gibbs

The Orange County District Attorney’s Office has charged a 20-year-old Yorba Linda man with the rape of three women, two of whom he met on MySpace

According to reports, within a span of three weeks in early 2009, the man met and arranged dates with two women on MySpace and then sexually assaulted each woman at the time of meeting.  The first woman was allegedly raped after she became intoxicated at a party in La Habra while the second woman was allegedly raped by intoxication at a hotel in Newport Beach

An ex-girlfriend came forward during the investigation and alleged the man repeatedly raped her between 2006 and 2007 as well.

The man, who also faces felony charges of residential burglary and receiving stolen property in a separate case, remains in custody.  His case is being heard at the North Justice Center in Fullerton

SEX OFFENDER RELEASED FROM STATE MENTAL HOSPITAL
Posted By The Law office of Barney B. Gibbs

A 40-year-old convicted sex offender was released from custody after prosecutors lost bid to keep the man incarcerated in a state mental hospital.

The man was convicted of raping a Huntington Beach woman in 1992 and molesting two minor girls in Los Angeles in 1993.  He was sentenced to concurrent terms of 13 and 8 years.  He was released in 2000 and, subsequently, committed to Coalinga State Mental Hospital in 2005 after violating his parole and being designated as a sexually violent predator

In 2008, however, state evaluators determined the man no longer suffered from a mental disorder thus could no longer be held under the predator law.  The Orange County District Attorney’s Office contested the man’s release, arguing he was preoccupied with sex, violent toward ex-girlfriends, responsible for stalking an ex-girlfriend and unable to follow the rules of parole supervision while out of prison.  The judge, though, ruled there was insufficient evidence to put the case before a jury

The man intends to reside in Topanga Canyon with an ex-girlfriend and her boyfriend.  Under the law, he will be required to register as sex offender and will also be listed on the Megan’s Law website.

ORANGE COUNTY MECHANIC GETS 14 YEARS FOR SEXUAL ASSAULT
Posted By The Law office of Barney B. Gibbs

A 39-year-old Tustin man was sentenced this month to 14 years in state prison for sexually assaulting five women.

The man, a car mechanic for Econo Lube and Tune, was convicted in August via jury trial of felony rape and assault with the intent to commit rape as well as multiple misdemeanor charges of sexual battery and battery.

According to the case prosecutor, on each occasion in 2007, the mechanic lured the women, ages 18 to 60, into the service bay at his Garden Grove workplace to discuss with them the repairs needed to be performed on their vehicles.  Once in the bay, however, he assaulted them.

Among the charges were allegations the man: sexually assaulted one woman after pushing her into an oil pan, licked and bit one woman on the ear while holding her around the waist, held one woman against a wall while pressing his body into her and fondled the breasts of yet another woman.  Two of the women reported the incidents to police and the three additional women came forward after hearing about the man’s arrest on the news.
