What is a sex crime?

In general, a sex crime involves unwarranted, unwelcomed, or nonconsensual sexual conduct. This includes forcing a person to engage in sexual actions against their will or while they are incapable of refusing. Sex crimes are one of the most complex accusations, as they typically result from private and personal situations about which only two people know the truth: you and your accuser.

Common sex crimes and their respective sections in the California Penal Code include:

  • Sexual assault (§ 243.4)
  • Rape (§ 261)
  • Marital rape (§ 262)
  • Rape of a child (§ 264.1)
  • Child pornography (§ 311.3)
  • Indecent exposure (§ 314)
  • Prostitution (§ 647b)

If you are facing sex crime allegations such as the ones listed above, it is crucial to contact an Anaheim criminal lawyer at our firm. We can help defend you against these charges and others, including internet sex crimes and statutory rape. The penalties for convictions of this nature have the ability to dramatically change a person's life. When your future is on the line, put your case in the hands of a firm you can trust.

Sex Offender Registration in California

Some sex offenses, such as indecent exposure and prostitution, are misdemeanors that usually result in a short jail sentence and/or a fine. Other offenses are far more severe, such as rape and child pornography, and will likely incur severe penalties including prison sentences that can be decades long, or even lifetimes. Perhaps one of the most damaging penalties of any sex crime, however, is the sex offender registry requirement.

All convicted sex offenders are required to not only register as a sex offender on the state registry, but on the national registry as well. The length of time one must be registered will differ depending on the offense. For example, sexual acts involving force or threatening require lifetime registration while sexual contact without permission would only require 15 years of registration.

In the U.S., three tiers of sex crimes have different registry requirements:

  • Tier 1 Offenses - This category involves the least severe group of sex offenses. Those convicted of a Tier 1 offense usually have to register on the sex offender registry for 15 years. Each year of their required registration, they will have to verify. Some example of offenses in this category include possession of child pornography and public indecency.
  • Tier 2 Offenses - Those convicted for a sex offense in this category will have to register for 25 years, and will also have to verify their registration twice a year. Most of the offenses that fall under this category are non-violent. Some include: sex trafficking of minors, sexual contact with a minor and production of child pornography.
  • Tier 3 Offenses - Offenses committed in this category typically warrant lifetime registration with registration verification four times each year. These include violent and non-violent serious sex offenses such as: sex by force (rape/sexual assault), sex with a child under age 12 and false imprisonment of a minor (under 18).

The requirement to register as a sex offender means that unlike most crimes, your conviction is extremely public and your information is easily accessible. This means that neighbors, friends, family, and colleagues will all know that you have been convicted of a sex crime and will likely judge you accordingly. Such harsh consequences could turn your life upside down, so it is essential to call The Law Office of Barney B. Gibbs today to help protect yourself.
