What is forgery and what are its penalties?

California Penal Code § 470 defines forgery as altering, creating or counterfeiting any signature or part of a document with the intent to defraud. Documents that are typically forged include contracts, I.D.s, legal certificates, historical documents, diplomas, and currency. Individuals who are charged with forgery are often charged with fraud, but it can also be a form of identity theft.

Examples of forgery include:

  • Forging someone's signature on a check so you can cash it to your benefit
  • Changing the marking on a document so that it appears to be valid after its expiration
  • Creating any legal document from scratch, such as checks, I.D. cards or passports

Penalties for forgery convictions can include:

  • Probation
  • Community service
  • Fines
  • Prison time

Not only can these sentences limit your freedom and restrict your civil liberties, but they can also heavily tarnish your reputation. Fraud charges often make finding work extremely difficult, as businesses may not trust you or may worry about their own reputation. Additionally, such a conviction may put a strain on your finances and, in turn, your personal relationships.

Forgery Defense Strategies

Facing charges of forgery can be intimidating without a knowledgeable and aggressive attorney on your side, especially if your charges are not based on truth. At The Law Office of Barney B. Gibbs, we understand that forgery charges can have devastating consequences on your life and will do everything in our power to ensure that you are not wrongfully convicted.

In many cases, an individual accused of committing forgery did not know that their document was altered or counterfeit. Again, displaying a forged document or I.D. as though it was real and valid is equal to forgery and will be penalized accordingly; however, if your attorney can prove that you had no way of knowing that the item was a fake, then your charges could be dismissed.

The most essential element to a prosecution's successful conviction on forgery charges is proving intent. Without intent, forgery charges are rarely carried out, as it must be proven that the accused committed the alleged crime with the intent to commit some form of fraud or larceny. For example, the copying of a work of art itself is not a crime, until someone attempts to profit from the copies by presenting them as originals. This is considered forgery.
