California Penal Code Sections 211-215

This is the portion of the California Penal Code that details the criminal offense of robbery. The California statutes include the word "fear" in the definition in relation to the threat of violence. If an individual is threatening violence or coercing a robbery by means of fear, then it can be labeled robbery. Because the definition of "fear" may play an important role in the legitimacy of a robbery offense, consider the verbiage of the penal code.

According to California Penal Code 212,

The fear mentioned in Section 211 may be either: 1. The fear of an unlawful injury to the person or property of the person robbed, or of any relative of his or member of his family; or, 2. The fear of an immediate and unlawful injury to the person or property of anyone in the company of the person robbed at the time of the robbery.

There are two degrees of robbery: first and second degree. A charge will depend upon the unique circumstances of every case.

  • First Degree Robbery - Imprisonment of three, six or nine years.
  • Second Degree Robbery - Imprisonment in the state prison for two, three or five years.
