Forgery Definitions

When most people think of forgery, they often think of mimicking someone else's signature on a document for some kind of personal gain. This is an example for forgery-- but is not the only kind. California Penal Code 470 PC defines forgery in much broader terms.

In California, forgery is committed when:

  • The accused signs someone else's name.
  • They alter or falsify any legal document.
  • They fake or steal someone else's handwriting.
  • They present a fake or altered document pertaining to money or property as a genuine article.

Forgery is a "wobbler," which means it can be charged as a felony or misdemeanor. If the forgery is committed to illegally obtain money or goods valued at $950 or less, it is considered a misdemeanor and can result in a maximum of one year in jail. For larger sums of money, it is considered a felony and result in a maximum of three years in jail.
